Walmart LP's are required to have four elements for a shoplifting bust.
- Selection. If they don't see you select it from the shelf, they can't bust you. You could say that the item was yours.
- Concealment. ONLY management or LP can make a stop if they PERSONALLY SEE you conceal.
- Constant Observation. The LP needs to maintain constant eyes on you as to ensure that you didn't ditch the item.
- Stop Outside. The LP or management cannot stop you inside of the store AND THEY CANNOT MAKE A STOP BASED ON ANYTHING DONE IN THE RESTROOM.
If you notice that any of these elements are missing... you have a case.
Note: Walmart policy is to make a stop for anything over $3 and aged 15-65.
If you are stopped, you will get a civil penalty of up to $150 (separate from criminal penalties), a ban from ALL Walmarts and Sam's Club. Then, YES, WALMART CALLS THE POLICE TO FILE A COMPLAINT FOR EVERY, EVERY, EVERY STOP. YOU MIGHT NOT LEAVE IN CUFFS, BUT A SHOPLIFTING COMPLAINT WILL BE SIGNED.
At court, if you ask for a lower charge, Walmart will allow something like disorderly conduct or disorderly persons or breech of peace.
This information IS correct.
