Walmart and Shoplifters

Walmart LP's are required to have four elements for a shoplifting bust.

  1. Selection. If they don't see you select it from the shelf, they can't bust you. You could say that the item was yours.
  2. Concealment. ONLY management or LP can make a stop if they PERSONALLY SEE you conceal.
  3. Constant Observation. The LP needs to maintain constant eyes on you as to ensure that you didn't ditch the item.
  4. Stop Outside. The LP or management cannot stop you inside of the store AND THEY CANNOT MAKE A STOP BASED ON ANYTHING DONE IN THE RESTROOM.

If you notice that any of these elements are missing... you have a case.

Note: Walmart policy is to make a stop for anything over $3 and aged 15-65.

If you are stopped, you will get a civil penalty of up to $150 (separate from criminal penalties), a ban from ALL Walmarts and Sam's Club. Then, YES, WALMART CALLS THE POLICE TO FILE A COMPLAINT FOR EVERY, EVERY, EVERY STOP. YOU MIGHT NOT LEAVE IN CUFFS, BUT A SHOPLIFTING COMPLAINT WILL BE SIGNED.

At court, if you ask for a lower charge, Walmart will allow something like disorderly conduct or disorderly persons or breech of peace.
